In according to the Order of the Ministry of Economy of Ukraine No. 991 "On the Procedure for Licensing the Export of Goods" dated 09.09.2009, the mandatory set of documents that shall be submitted to the Ministry by the enterprise to obtain a license to carry out an the export operation includes the Expert examination report on the country of origin of goods and product code according to product codes as per ukrainian classification.
For issuing the Expert examination report on the country of origin of goods and the code of goods according to product codes as per ukrainian classification for the purpose of obtaining the license for export of goods, the following set of documents is submitted:
In the case of export of goods/ services on a deferred basis or import of goods/ services on a prepayment basis, money or goods/ services shall arrive in Ukraine within a period not exceeding 365 calendar days, in accordance with the Resolution of the National Bank of Ukraine No. 5 “On Approval of the Regulation on Measures protection and determination of the procedure for the implementation of certain transactions in foreign currency" dated 02.01.2019. In case of violation of this period, there is applied to the resident a penalty for each calendar day of delay at the rate of 0.3% of the amount of the proceeds not received by the resident in foreign currency, or the cost of the undelivered goods/ services, in accordance with Article 13 of the Law of Ukraine "On Currency and Foreign Exchange Transactions" No. 2473- VIII from 21.06.2018.
However, in the event that the resident performs operations under contracts of industrial cooperation, consignment, construction, tender delivery, guarantee service, delivery of complex technical products and special-purpose goods, the established settlement periods for export-import transactions may be extended for a certain period. To do this, the enterprise must apply to the Ministry of Economic Development, Trade and Agriculture of Ukraine with the justification of the need for such an extension in accordance with the Resolution of the Cabinet of Ministers of Ukraine No. 104 “On approval of the procedure for issuing the conclusion on extension of the deadline for payments on certain operations for the export and import of goods established by the National Bank" dated 13.02.2019.
The customs authorities have the right to monitor the correctness of the determination of the customs value by the declarant, in particular, to require additional documents to confirm the declared customs value.
Such an additional document is the Expert examination report for confirmation of the customs value, drawn up by a certified expert appraiser of the Chamber of Commerce and Industry.
The expert examination report on confirmation of the customs value of the goods is important in that it allows you to avoid adjusting the value of goods by customs, significantly reduce taxes and customs duties.
When exporting the goods manufactured in the territory of Ukraine to the near and far foreign countries, the manufacturer shall confirm the value of his goods at the customs authorities of the importing country.
Such confirmation is expressed by the expert examination report on the value of the goods produced and by affixing the certification signature to the manufacturer's price list. The certification signature is carried out in the language of the importing country.
